Michael Campion, of OMLO, successfully represented the Foothill Municipal Water District Board of Directors, obtaining a judgment denying petition for writ of mandate from the Superior Court of the State of California County of Los Angeles – Central District on May 24, 2021.
The writ challenged the District’s termination of an employee for misconduct, alleging that the petitioner was denied rights entitled to a permanent public employee, including “to not be terminated without good cause, proper notice, and a hearing,” even though the District maintained that its employees are at-will. Per Mr. Campion’s successful argument, the petitioner failed to establish that an employment agreement not to terminate the petitioner without cause existed, and the Court concluded that the petitioner did not have a reasonable expectation that he would be terminated only for cause or of a property right in continued employment, and returned a judgment in favor of the District.
