Professional Experience

Kyle Waldie is a Senior Associate with Olivarez Madruga Law Organization LLP, as part of the firm’s Labor and Employment and Education Law practice groups. Mr. Waldie represents employers in all types of employment matters, including complex and employment class actions, wrongful termination, discrimination, prevailing wage, harassment, wage and hour claims, as well as DFEH and EEOC complaints. He has represented clients in state and federal trial courts, appellate courts, and before numerous state and federal administrative agencies and in arbitrations.

Selected Representative Matters

  • Defeated class certification in state court on behalf of a tow truck company in lawsuit brought on by drivers alleging claims for unpaid overtime, missed meal and rest periods, waiting time penalties, and unfair business practices.
  • Defeated class certification in federal court on behalf of company whose employees alleged claims for FLSA violations, unpaid overtime, missed meal and rest periods, waiting time penalties, civil penalties under the Private Attorney General’s Act of 2004, and unfair business practices.
  • Prevailed in jury trial and on appeal on behalf of architecture firm sued by former client for professional negligence and breach of contract.
  • Prevailed in administrative law trial on behalf of construction company accused by Labor Commissioner alleging misclassification, prevailing wage minimum wage and overtime violations, missed meal and rest periods, and waiting time penalties.
  • Won complete defense judgment in bench trial and on appeal for garment manufacturer sued by a large county for alleged failure to pay for all wastewater discharges, penalties, and
  • Won dismissal with waiver of costs in class action lawsuit brought by independent contractors alleging misclassification, minimum wage and overtime violations, missed meal and rest periods, waiting time penalties, and unfair business practices.
  • Obtained dismissal of class action lawsuit against garment manufacturer whose employees alleged claims for unpaid overtime, missed meal and rest periods, waiting time penalties, and unfair business practices.
  • Defeated summary judgment and obtained favorable settlement of claims of wrongful termination and wage and hour violations.
  • Obtained successful trial ruling for newspaper client on anti-SLAPP motion; prevailed on appeal.
  • Won defense ruling in arbitration for client accused of breach of contract, fraudulent transfer of assets, and securities fraud.
